Thomas Assembly Center Use Policy 

Insurance Requirements

Any person or organization using university facilities shall procure and maintain for the duration of facility use insurance against claims for injuries to persons or damages to property which may arise from or in connection with the operation and use of university facilities.  The cost of such insurance shall be borne by the user of university facilities.

 1.    MINIMUM  SCOPE  OF  INSURANCE

Coverage shall be at least as broad as:

Insurance Services Office form number GL 0002 (Ed. 1/73) covering Comprehensive General Liability and Insurance Services Office form number GL 0404 covering Broad Form Comprehensive General Liability; or Insurance Services Office Commercial General Liability coverage (“occurrence” form CG 0001). “Claims Made” form is unacceptable.  The “occurrence form” shall not have a “sunset clause”.

Workers’ Compensation insurance as required by the Labor Code of the State of Louisiana and Employers Liability insurance.

 2.    MINIMUM  LIMITS  OF  INSURANCE

User shall maintain limits no less than:

Comprehensive General Liability: $1,000,00 combined single limit per occurrence for bodily injury, personal injury and property damage.

Workers’ Compensation and Employers Liability: Workers’ Compensation Limits as required by the Labor Code of the State of Louisiana and Statutory Employers Liability limits.  Exception: Employers Liability to be $1,000,000 if work is to be done over water.

 3.    DEDUCTIBLES  AND  SELF-INSURED  RETENTIONS

Any deductibles or self-insured retentions must be declared to and approved by Louisiana Tech University.  At the option of Louisiana Tech University, either: the insurer shall reduce or eliminate such deductibles or self-insured retentions as respects to Louisiana Tech University, its officers, officials and employees; or the user shall procure a bond guaranteeing payment of losses and related investigations, claim administration and defense expenses.  

4.    OTHER  INSURANCE  PROVISIONS  

General Liability

Louisiana Tech University, its officers, officials, employees and volunteers are to be covered as "additional insureds" as respect to liability arising out of premises owed, occupied or used. The coverage shall contain no special limitations on the scope of protection afforded to Louisiana Tech University, its officers, officials, employees or volunteers.

The user's insurance coverage shall be primary insurance as respects to the university, its officers, officials, employees and volunteers.  Any insurance or self-insurance maintained by the university, its officers, officials, employees or volunteers shall be excess of the users insurance and shall not contribute with it.

Any failure to comply with reporting provisions of the policies shall not affect coverage provided to the university, its officers, officials, employees or volunteers.

Coverage shall state that the user's insurance shall apply separately to each insured against whom claim is made or suit is brought, except with respect to the limits of the insurer's liability.

Workers' Compensation and Employers Liability Coverage

The insurer shall agree to waive all rights of subrogation against the university, its officers, officials, employees and volunteers of losses arising from the leased premises.

All Coverages

Each insurance policy required by this clause shall be endorsed to state that coverage shall not be suspended, voided, canceled, reduced in coverage or in limits except after thirty (30) days' prior written notice by certified mail, return receipt requested, has been given to the university.

5.     ACCEPTABILITY OF INSURERS

Insurance is to be placed with insurers with a Best's rating of no less than A:VI.  This requirement will be waived for workers' compensation coverage only for those users whose workers' compensation coverage is placed with companies who participate in the State of Louisiana Workers' Compensation Assigned Risk Pool.

6.     VERIFICATION OF COVERAGE

User shall furnish the university with certificates of insurance effecting coverage required by this clause. The certificates for each insurance policy are to be signed by a person authorized by that insurer to bind coverage on its behalf. The certificates are to be on standard insurance agency forms or forms provided by the university before use of university facilities commences. The university reserves the right to require complete, certified copies of all required policies, at any time.
